Terms and Conditions of Prameyshala EdTech Platform

These Terms and Conditions ("Terms") govern your access to and use of the Prameyshala EdTech Platform ("Platform"), provided by Webkolek, a sole proprietor firm registered in India. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.

"Platform" refers to the Prameyshala EdTech Platform provided by Webkolek.

"User" refers to any individual who accesses or uses the Platform.

"Content" refers to any text, images, videos, audio, or other materials available on the Platform.

"Account" refers to the user account created by a User on the Platform.

"Third-Party Links" refers to any links provided on the Platform that direct Users to external websites or resources not owned or controlled by Webkolek.

2.1 By accessing or using the Platform, you represent and warrant that you are at least 18 years old or have the legal capacity to enter into these Terms. If you are accessing or using the Platform on behalf of a legal entity, you further represent and warrant that you have the authority to bind that entity to these Terms.

2.2 Users below the age of 18 must obtain consent from a parent or legal guardian before accessing or using the Platform.

3.1 The Platform is designed to provide educational content and resources to Users. Webkolek grants you a non-exclusive, non-transferable, revocable license to access and use the Platform, subject to these Terms.

3.2 Users are solely responsible for their use of the Platform, including any Content they create, upload, or share on the Platform. Users must not use the Platform for any illegal or unauthorized purposes.

3.3 Users agree to comply with all applicable laws, regulations, and these Terms while using the Platform.

4.1 In order to access certain features of the Platform, Users may be required to create an Account. When creating an Account, Users must provide accurate and complete information and promptly update any changes to maintain accuracy.

4.2 Users are responsible for maintaining the confidentiality of their Account credentials and are solely responsible for all activities that occur under their Account.

4.3 Webkolek reserves the right to suspend or terminate User Accounts if there is any violation of these Terms or if there is any suspicious or unauthorized activity related to the Account.

5.1 All intellectual property rights in the Platform, including but not limited to software, logos, trademarks, and Content, are owned by or licensed to Webkolek.

5.2 Users retain ownership of the Content they create, upload, or share on the Platform. By posting Content, Users grant Webkolek a non-exclusive, worldwide, royalty-free, and transferable license to use, modify, reproduce, distribute, and display the Content on the Platform for the purpose of providing the services.

6.1 The Platform may contain links to third-party websites or resources that are not owned or controlled by Webkolek. Webkolek has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or resources.

6.2 Users acknowledge and agree that Webkolek shall not be responsible or liable for any damages or losses arising from the use of any third-party websites or resources accessed through the Platform.

7.1 To the maximum extent permitted by law, Webkolek and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with the use or inability to use the Platform.

7.2 Webkolek shall not be responsible for any interruption, delay, or error in the operation of the Platform or any Content accessed through the Platform.

Users agree to indemnify and hold harmless Webkolek and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or in connection with the User's use of the Platform, violation of these Terms, or violation of any rights of third parties.

Webkolek reserves the right to modify or terminate the Platform or these Terms at any time, with or without notice. Users are advised to review these Terms periodically for any changes. Continued use of the Platform after any modifications to these Terms constitutes acceptance of the modified Terms.

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in [Insert City], India.
